NORTHERN BEAR PLC, the £50m turnover County Durham based building services group, has given notice to its shareholders that one of its 12 subsidiary companies is facing potential legal action up to £1.9 million.

The legal action was initiated by Engie Regeneration, a regeneration, RMI and housing development company that is part of French headquartered multinational Engie Group. The action was launched against Springs Roofing Ltd about a roofing contract. The potential claim was disclosed as a contingent liability in the company’s annual report and accounts for the year to March 2021. The directors of Springs Roofing received correspondence about the claim during the year.

Legal Action

Springs Roofing Ltd, based in Chester-le-Street, County Durham, offers flat and pitched roofing, as well as leadwork and roof trusses. The firm turned over £9.5 million in the year to March 2021. The disputed roofing contract work was undertaken over a two year period from April 2009 to March 2011.

The directors say they have reviewed the legal correspondence and believe that any claim would be entirely without merit. They say their stance is supported by third party technical expert and legal advice taken which suggests that the customer would have great difficulty in making a successful claim.

All correspondence to date has taken the form of pre action protocol and, should any formal proceedings be issued, Springs Roofing has stated that it will “vigorously defend the claim”.
